Parent of a British child visa

The parent of a British child visa allows non-UK nationals to live in the UK to care for or maintain contact with their British child. Our solicitors advise on eligibility, evidence, and applications, helping parents secure lawful status in the UK.

This visa is for parents who have responsibility for, or regular access to, a British child living in the UK. It allows the parent to remain in the UK to provide care and maintain a relationship with the child.

Following the October 2025 reforms under HC 1333, new suitability and relationship evidence standards now apply, ensuring applications meet the Home Office’s updated criteria for family and private life routes.

Eligibility requirements

Applicants must usually show:

  • The child is under 18, lives in the UK, and is a British citizen or settled.
  • They have sole or shared parental responsibility, or direct access through a court order or agreement.
  • They are taking an active role in the child’s upbringing.
  • They can maintain themselves without relying on public funds.
  • They meet the English language requirement.

Application process

  • Step 1 – Confirm eligibility and prepare evidence of the parent-child relationship.

  • Step 2 – Complete and submit the online application.

  • Step 3 – Upload supporting documents and attend a biometric appointment.

  • Step 4 – Await the Home Office decision, usually within 8–12 weeks.

Evidence required

Key evidence often includes birth certificates, court orders, school letters, GP records, and proof of cohabitation or ongoing parental involvement.

Under the 2025 changes, stronger proof of direct parental care or ongoing access may be required where parents live separately.
